What is Disciplinary Control?

It is a self-regulatory mechanism used by the public administration to safeguard the principles governing public service, in fulfillment of the purposes of the State and the interests of society through Disciplinary Law. This mechanism enables administrative authorities to prevent, correct, and sanction conduct that violates the ethics of public service, while ensuring the obedience, discipline, integrity, and efficiency of public servants, who are required to comply strictly with the legal framework governing their actions as representatives of the State.

Subjects of the Disciplinary Regime

The subjects of the University of Cauca’s disciplinary regime are all individuals who have a legal or regulatory employment relationship with the Institution, including tenured faculty members and administrative employees, as well as individuals employed under employment contracts, that is, official workers. In addition, all individuals appointed under the temporary staffing system are also subject to the disciplinary regime.

What is meant by disciplinary action?

It is the authority vested in both the public administration and all citizens to bring matters before the competent authorities so that investigations may be conducted and the corresponding legal sanctions imposed on public servants who commit irregularities in the performance of their duties. Accordingly, any conduct provided for in this Code that entails a breach of duties, an excess in the exercise of rights and functions, a violation of prohibitions, or an infringement of the rules governing disqualifications, incompatibilities, impediments, and conflicts of interest constitutes a disciplinary offense and gives rise to the corresponding disciplinary sanction, unless covered by any of the grounds for exemption from liability established by this law.
