Legal Advisory Office of the University of Cauca

Mission

The Legal Advisory Office of the University of Cauca defines the legal guidelines of the University. Its objective is to provide legal advice to the offices of the University of Cauca. To this end, it issues legal opinions, provides guidance and support in the management and resolution of matters with a legal and/or juridical impact of interest to the Alma Mater. In addition, it legally represents the University’s interests in litigation before the different jurisdictions and defends its interests through alternative dispute resolution mechanisms and in administrative proceedings in which it is involved.

Mission

Judicial defense is exercised in judicial proceedings before the competent judge, representing the interests of the University. Extrajudicial defense is carried out in administrative proceedings and conciliations before the Office of the Attorney General of the Nation.

Protection Actions

The judicial defense mechanism to which any person may resort to request the immediate protection of their fundamental rights in situations where these have been violated or threatened by actions or omissions of public authorities, and exceptionally by private individuals in cases specifically provided for by law.

Administrative Acts

Documents reflect the will of the University administration and are intended to enforce the law, clarify its content, and create, modify, or extinguish legal situations. For the most part, they have a positive impact on the University of Cauca community or its stakeholder groups, depending on their scope of application.

Legal Concepts

They are statements issued by the University administration to clarify legal questions or regulatory conflicts. They are issued in accordance with Article 28 of the Code of Administrative Procedure and Administrative Litigation (Law 1437 of 2011), as replaced by Article 1 of Statutory Law 1755 of 2015. They do not imply liability on the part of the University of Cauca, nor are they mandatory; they only constitute guiding criteria.

Monitoring of Court Rulings

Lead and coordinate with the different University offices the fulfillment of judicial orders and recommendations issued to the University of Cauca.

Functions

The functions of the Legal Office of the University of Cauca are:

Advise the Rector, Superior Council, Academic Council, and other offices of the University on legal matters and issue opinions requested on such matters.
Represent the University judicially and extrajudicially in matters entrusted by the Rector's Office and monitor their progress before any administrative or judicial authority.
Prepare or review the drafts of contracts entered into by the Institution, ensuring that they comply with legal and regulatory provisions.
Prepare and/or review the administrative acts and contracts of the University to ensure that they comply with legal provisions and internal regulations.
Study, at the request of the Rector, Superior Council, and Academic Council, the appeals filed against the administrative acts issued by them and draft the corresponding decisions.
Issue opinions on the interpretation of the legal provisions applicable to the University.
Conduct and handle pre-litigation conciliations in accordance with the procedures and legal grounds currently in force on the matter.
Study and defend the University in the protection actions filed against it and/or its different bodies or offices, as well as monitor compliance with the rulings and submit reports on the proceedings.
Any other duties assigned to it in accordance with the legal and regulatory provisions in force.
