Summary of the OCDI

Internal Disciplinary Control is a self-protection mechanism used by the administration to safeguard the principles governing public service, as well as the purposes of the State and the interests of its members. To this end, it relies on disciplinary law, which consists of a series of substantive and procedural rules that allow authorities to “correct, prevent, and sanction” conduct that disregards public service ethics and, in turn, guarantee “obedience, discipline, integrity, and efficiency” among those who have a special relationship with the administration, requiring them to strictly comply with the complex body of regulations governing their conduct as agents of the State.

Initiation of Disciplinary Proceedings

In accordance with the provisions of Article 86 of Law 1952 of 2019, as amended by Law 2094 of 2021, “Disciplinary proceedings shall be initiated and conducted ex officio, or based on information provided by a public servant or from another source that merits credibility, or upon a complaint filed by any person, and shall not proceed based on anonymous reports, except in cases where they meet the minimum requirements established in Article 38 of Law 190 of 1995 and Article 27 of Law 24 of 1992.”
